Response from Vicki:

Hello, and thank you for asking a question through our website. I greatly empathize with you in this situation.

DAT TruckersEdge - Most Loads. Best Rates. Serving Owner-Operators Since 1978. 10% off your first 12 months. New customers only.

If you are a professional truck driver who agreed to drive for a trucking company under certain conditions — and those conditions were met — then, yes, the company may have legal grounds to keep your paycheck.

I hope that you read and understood all of the fine print on all of the legal documents you signed before you started driving for the company. If you didn’t sign any legal documents, then you may have rights worth pursuing legally.

If you are an owner-operator or lease-purchase driver, it is ultra-important to not only read but also [understand] all of the terms to which you’re agreeing before you sign legal documents.

If it is the case that you accepted a dispatch that contained a financial penalty when certain conditions were met — such as arriving late at the receiver’s location — and you met those conditions, then, yes, you may have to pay.

Since you did not send your name or email address, there is no way for me to get back in touch with you. Since you did not give specifics about your situation, I will simply refer you as follows:

1. If this is a matter that needs to be looked into by an attorney, please contact one specifically skilled in the [trucking industry].

2. If this is a matter regarding a broker, please contact Dan Metully of TransportWatch.com to see if he can help you. (He may also be able to help you in other ways.)

3. If this is a matter of a bottom-dwelling, scum-sucking trucking company that is trying to exploit you financially, consider cutting your losses as soon as you can and go to work for a more reputable company.

If none of the situations that I’ve described on this page apply, please contact us through the form on our website. We are not attorneys ourselves, but we may be able to provide some direction.

I wish you great success in getting what is rightfully yours.

My husband Mike and I wish you safe travels and lots of money saving opportunities on the road.

Best regards,
Vicki Simons
